Resolution demanding setting up of Media Council

As purveyors of Information we, the members of National Union of Journalists (India) share the responsibility of serving the people. We are constrained to share our concern about the Press Council of India for its decline in the recent years, especially its fourteenth term. The Council established with the statutory mandate of preserving the freedom of the Press and maintaining and improving the standards of newspapers and news agencies in India, has failed to measure up to its mandate. The process of constituting the Council was changed by the erstwhile Council chairman resulting in making the council a vessel of non-professional bodies including press clubs and small factional splinter groups. The rot started with the process to finalise the list of associations of persons to submit names for reconstitution of the Council for the next three-year term.

However the outgoing Chairman adopted a scrutiny procedure for the claims in which all outgoing members of the Council with clearly known connections with claimant associations were involved in the scrutiny. This went against the letter and spirit of provisions laid down to avoid conflict of interest and vitiated the process of scrutiny and finalisation of claiment organisations and resulted in all major bodies of media professionals being ousted from the process of reconstitution of PCI, while some state level and city level bodies viz. Press Clubs came to constitute majority of the list of bodies notified for submitting lists of nominations.

As a result, bodies like National Union of Journalists (India), Indian Federation of Working Journalists, etc that were associated with the Press Council of India since its inception were excluded and as a result of cartelisation, state level and city level bodies appropriated seats on the Council. The Council, which is a national body but its constitution is now from state level and city level bodies, severely limiting the talent pool for members of the PCI.

We have observed that some of these bodies have managed to enter the list with dubious documents, while some of these are pocket organisations. The entry of three Press Clubs — Kolkata, Mumbai, Raipur — in the list is intriguing as press clubs do not have the same objectives as the Press Council of India has. Press Clubs are mainly focused on providing club-like facilities to media persons and their families etc.

Professional bodies have been demanding that the Press Council of India should be converted into a Media Council to regulate TV/Radio, Electronic, online and social media in the same way that PCI has been doing for Print Media. The Press Council has also passed resolutions to this effect. Former Information and Broadcasting Minister Late Sushsma Swaraj, had also been of the same opinion. National Union of Journalists (India) hereby demands that the Press Council should be subsumed in to Media council with mandate to regulate Electronic, online and digital media, including OTT platforms, in tune with current requirements.

” नेशनल यूनियन आफ जर्नलिस्ट्स इंडिया जिसका गठन 23 जनवरी 1972 को किया गया तथा 27 जून 1997 को ट्रेड यूनियन एक्ट 1926 के तहत जिसका पंजीयन कराया गया वह संस्था हमारे लिए गौरव का प्रतीक है। इसको सर्वोच्चता प्रदान करने के लिए देश के मूर्धन्य पत्रकार और हम सब लोगों के लिए प्रेरणादायी नेतृत्व की बड़ी भूमिका रही है। हम इस भूमिका और गौरव को हर कीमत पर अक्षुण्य रखेंगे। हम समवेत स्वर में इस बात पर अपनी चिंता और क्षोभ व्यक्त करते हैं। हमारे बीच के ही कुछ पुराने साथी राष्ट्रवादी पत्रकारिता आंदोलन को प्रभावित करने का कुचक्र रच रहे हैं। ववे नेशनल यूनियन ऑफ जर्नलिस्ट्स (इंडिया) के नाम का दुरुपयोग करते हुए इसे अपने आर्थिक हित संवर्धन का माध्यम बना रहे हैं। हम सब इसकी कठोर शब्दों में निंदा करते हैं। यह कार्यसमिति एक बार फिर भटके हुए पुराने साथियों से अपील करती है कि वह मुख्यधारा में शामिल होकर संगठन के पुराने गौरव के प्रति अपना सम्मान प्रकट करें। यह कार्यसमिति देशभर के पत्रकार संगठनों, पत्रकारों तथा पत्रकारिता से संबंध प्रशासकीय संस्थाओं से अपील करती है कि नेशनल यूनियन ऑफ जर्नलिस्ट (इंडिया) के इस मूल संगठन को नुकसान पहुंचाने और छवि को धूमिल करने वाले तत्वों के प्रति सचेत रहें तथा उन्हें किसी भी स्थिति में अपना न समर्थन दें।”
” माननीय न्यायालय में भी हमारा ही पक्ष साबित हुआ है। हम नेशनल यूनियन आफ जर्नलिस्ट्स (इंडिया) के संविधान में पूर्ण आस्था रखते हुए अक्षरशः उसका पालन कर रहे हैं। माननीय न्यायालय में जब हमारे चुनाव को चुनौती दी गई है तब उन्हें मुंह की खानी पड़ी। वे अब उस मामले में न्यायालय में उपस्थित होने से भी कतरा रहे हैं। इसी प्रकार दूसरे मामले में हमारे द्वारा दायर याचिका को अस्वीकार करने की अर्जी लगाई गई थी। जिसे भी माननीय न्यायालय ने खारिज करते हुए हमारे पक्ष को अधिक प्रभावशाली माना। हमारे वरिष्ठ नेताओं द्वारा गठित की गई तदर्थ समिति और उसके द्वारा संविधान सम्मत कराए गए चुनाव के बाद नेशनल यूनियन आफ जर्नलिस्ट्स (इंडिया) के आम चुनाव संविधान के दिशा निर्देशों के अनुसार निरंतर संपन्न होते रहे हैं। प्रदेशों में हमारी संबंद्ध इकाइयां, उनकी गतिविधियां और वहां संविधान के अनुसार कार्य हमारी सबसे बड़ी शक्ति है।”

अतः नेशनल यूनियन ऑफ जर्नलिस्ट्स (इंडिया) की जाजपुर ओडिशा में समवेत यह बैठक संकल्प लेती है कि हमारी गरिमा और स्थापना के उद्देश्यों की पूर्ति के लिए हम प्रतिबंध रहकर कार्य करेंगे तथा ऐसे तत्वों को जो संस्था की प्रतिष्ठा के प्रतिकूल काम कर रहे हैं बेनकाब करेंगे अपने-अपने राज्यों में ऐसी मुहिम चलाकर राष्ट्रीय स्तर पर देश के सबसे बड़े राष्ट्रवादी पत्रकारों के इस फेडरेशन की प्रतिष्ठा और गौरव को पुनर्स्थापित करने के लिए कार्य करेंगे।

जन सरोकार की पत्रकारिता की ओर लौटे पत्रकार जगत

देश में पत्रकारिता के प्रति स्थापित सम्मान में निरंतर कमी देखने को मिल रही है। हालांकि इसमें कोई संदेह नहीं है कि भारतीय पत्रकारिता विश्व में एक विशिष्ट स्थान रखती है। इसके बाद भी पत्रकारिता के प्रति भारतवर्ष में आम लोगों का रुझान निरंतर परिवर्तित हो रहा है। कुछ खास किस्म की रिपोर्टिंग और इलेक्ट्रॉनिक चैनलों पर होने वाली बहस (डिबेट) से आम जनता में निराशा उत्पन्न हो रही हैं। यह पत्रकार जगत के लिए गंभीर चिंता और चिंतन का विषय होना चाहिए। पत्रकारिता के प्रति आजादी के समय और उसके बाद के कई दशकों तक जो सम्मान और महत्व था वह निरंतर क्यों कम हो रहा है? यह भी आज मीडिया जगत के लिए चिंतन का विषय होना चाहिए। राजनीतिक खबरों ने और उसमें भी विशेष रुप से गिरावट के शब्द और लोकतांत्रिक मूल्यों से अलग हटकर की जाने वाली गतिविधियों का समाचार जगत में अधिक स्थान होना वही रचनात्मक और विकासात्मक समाचारों का कम स्थान पाना समाचार जगत की प्रतिष्ठा के प्रतिकूल बनता जा रहा है। हालांकि मीडिया जगत से यह तर्क दिया जाता है कि जो घट रहा है वही समाज के बीच में मीडिया परोसता है। फिर भी मीडिया के दायित्वों में यह नहीं होना चाहिए कि वह संतुलन बनाना न भूल जाए? इसलिए यह विषय प्राथमिकता से चर्चा का केंद्र में होना चाहिए।

नेशनल यूनियन ऑफ जर्नलिस्ट (इंडिया) की जाजपुर उड़ीसा में समवेत कार्यसमिति की यह बैठक मीडिया जगत में हो रही इस बदलाव पर अपनी चिंता व्यक्त करते हुए मीडिया जगत से अपील करती है कि वह जन सरोकार की पत्रकारिता की ओर वापसी करें। देश को राजनीतिक, सामाजिक और अन्य क्षेत्रों में आ रही गिरावट की जानकारी उपलब्ध कराने के अपने कर्तव्य का परिपालन करते हुए यह संतुलन भी बनाए कि रचनात्मक, विकास और सामाजिक सुधार के जो कार्य हो रहे हैं उनकी अनदेखी ना हो जाए। हम मीडिया जगत से अपील करते हैं कि वे इन सुझावों पर विचार करते हुए अपनी भविष्य की कार्यप्रणाली की संरचना इस प्रकार करें कि पत्रकार जगत की विशिष्ट स्थिति और सम्मान बरकरार रहे।

Resolution on Wage Boards

This meeting of the National Union of Journalists (India) expresses deep disappointment at the long delay in setting up of wage-boards, more than 16 years after the setting up of the Majithia Wage Boards by the Government of India in 2007. The wages of Central Government employees have undergone two revisions after the setting up of the Majithia wage-boards by the Government of India, even as the newspaper and news agency employees continue to wait for setting up of the next wage boards. The Wage Board under the Chairmanship of Justice Majithia set up as per the provisions of The Working Journalists and Other Newspaper Employees (Conditions of Service) and Miscellaneous Provisions Act, 1955, submitted their final reports to the Government of India on 31st Dec., 2010. This amounts to denial of administrative justice and abdication of statutory responsibilities by the Government of India and needs to be addressed forthwith. That the recommendations of the Majithia wage-boards with new wage scales took three years in preparation suggests that the industry will have to wait for updating wage structure for several more years.

Another painful aspect of the pitiable condition of the working journalists and other newspaper employees is related to continued defiance by majority of newspaper managements of the Supreme Court order dated 7 February 2014 directing all newspaper and News agency establishments to implement the Majithia wage-boards award forthwith. We are pained to record that the newspaper owners continue to defy the order of the highest court in the land indefinitely and newspaper/news agency employees across the country continue to suffer this injustice. This situation calls into question the very stability and strength of our system of democracy and the Constitution that solemnly promises Justice to all citizens. Needless to say, such denial of justice will undermine our democracy and the Constitutional structures that upholds justice. If a workman is denied proper wages the work suffers and so does society and the nation.

This meeting of National executive committee of National Union of Journalists India held at Jajpur, Odisha (May 13 and 14, 2023) calls upon Governments at all levels to act urgently to ensure setting up of the wage-boards immediately and to take steps to ensure administrative justice to end the defiance by the newspaper industry using their statutory powers to protect the national interest. Governments are duty bound to ensure that the apex court order is implemented expeditiously.
